This Website Terms of Use Agreement (these “Terms of Use”) is made by and between CURACORE VET, PLLC, doing business as “CuraCore,” (the “Company,” “we,” or “us”) and you the user (“you,” “your,” or “User”), and governs your use of our website (available at https://curacore.org/vet/ (the “Website,” including, as applicable, any other sites maintained by us, including, without limitation, https://curacore.academy and http://curacore.litmos.com/)) and any services, content, or other materials or offerings offered by or through the Website, including, without limitation, our e-learning portal (collectively, “Service” or “Services”). Please review these Terms of Use carefully. If you do not agree to these Terms of Use, you are not authorized to use the Website or any Service. BY ACCESSING, VISITING, BROWSING, USING, OR ATTEMPTING TO INTERACT WITH OR USE ANY PART OF THE WEBSITE OR ANY SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST THE AGE OF MAJORITY IN YOUR JURISDICTION, AND AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS OF USE.

  1. Agreement.As noted above, these Terms of Use govern your access to and use of the Website and any Company Service offered by or through the Website. THE COMPANY RESERVES THE RIGHT, WITH OR WITHOUT NOTICE, TO MAKE CHANGES TO THESE TERMS OF USE AT ANY TIME AND AT THE COMPANY’S DISCRETION. YOUR CONTINUED USE OF ANY PART OF THE WEBSITE OR ANY SERVICE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES TO THESE TERMS OF USE. YOU SHOULD REVIEW THESE TERMS OF USE PERIODICALLY TO DETERMINE IF ANY CHANGES HAVE BEEN MADE. YOU CAN REVIEW THE MOST CURRENT VERSION OF THESE TERMS OF USE AT ANY TIME ON THIS PAGE.

Privacy, Acceptable Use, and Other Policies.Your use of the Website and any Service is also governed by, and subject to, any posted policies, guidelines or rules applicable to use of the Website and any Service provided by or through the Website, including, but not limited to, (i) our Privacy Policy (available at [link]), (ii) our Acceptable Use Policy (available at [link]), (iii) any other policies which may from time to time be posted on and to the Website, which such policies, guidelines and rules are hereby incorporated by reference into these Terms of Use. Your use of the Website and Services may also be governed by any other agreement(s) between you and the Company (if any). Additionally, because the Website is powered by Shopify Inc., including, as applicable, its parents, subsidiaries, and affiliates (“Shopify”), and because our e-learning portal is hosted by Litmos US, L.P., including, as applicable, its parents, subsidiaries, and affiliates (“Litmos”), personal information may be subject to Shopify’s Privacy Policy, which can be viewed here, and/or Litmos’ Privacy Policy, which can be viewed here. Among other things, Shopify and/or Litmos may collect and process personal information about your access to and use of the Website and Services, and information you submit to the Website or Services may be transmitted to and shared with Shopify and/or Litmos, as well as third parties that may be located in other countries than where you reside. By using the Website or Services, you acknowledge that you have read and agree to the referenced policies in this Section. 
  2. Website Content.As noted below, the Website and any Service is provided on an “as is” basis and may use internet services that are not under our direct control. While we strive to provide accurate descriptions of our products and services, we do not warrant that the descriptions, pricing, or other content on the Website are accurate, complete, or current. We reserve the right to correct errors and to cancel any orders that were placed using incorrect descriptions or pricing. We do not warrant that the Website, Services, or their features will be accessible at all times or that they will function in an error-free manner. We reserve the right to cease operating the Website, any Service, or any of their features at any time. Additionally, all content on the Website or included in any Service is for personal, non-commercial use only, and is intended for educational purposes. Unless otherwise specifically provided on the Website or with respect to a specific Service, the Services and Website content are intended for the education of veterinary professionals (including, if applicable, veterinary students) only, and in no event is any content or Service intended to, nor should, replace advice from a licensed veterinary professional.

Intellectual Property.All content on the Website including, without limitation, all Services, and all graphics, logos, trademarks, images, video, audio, and software, and the design, selection, and arrangement thereof, is, and shall continue to be, the property of the Company or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Website or Service is prohibited, except as may otherwise be expressly permitted by the Company in writing or as may otherwise be expressly allowed under these Terms of Use. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of the Website or Services.
  4. Website & Service Use.The Website and any Service is for your personal and non-commercial use, unless otherwise specified. You may not use any Service provided by or through the Website for any other purpose, including any commercial purpose, without the prior express written permission of an authorized representative of the Company. Your access to and use of the Website or Services is at all times subject to our Acceptable Use Policy, available [here].  In addition to the restriction on use detailed in the Acceptable Use Policy, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website or Services; (b) collect or track the personal information of others; (c) spam, phish, pharm, or pretext the Website or Services; (d) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Website or Services; (e) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Website or Services; or (f) engage in a direct or indirect act to modify, translate, or copy any Website or Service content, including, but not limited to, the use of AI notetakers and screen recording devices. We reserve the right to suspend, disable, or terminate your access to the Website and/or Services at any time, without notice, if we determine that you have violated any part of these Terms of Use. 
  5. Links to Other Sites.The Website may provide links to other websites. These Terms of Use and the Company’s other policies may not, and likely do not, apply to those other websites, which may have their own terms and policies. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Website to access these materials or third party sites, you do so at your own risk. We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. You should review the terms of use, privacy policies, and any other policies of any other websites that you visit. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the applicable third-party. 
  6. Compliance with Laws.As noted elsewhere, you agree to comply with all applicable federal, state, and local laws regarding your use of the Website and Services. You further agree that information provided by you is truthful and accurate to the best of your knowledge. If you are outside the United States you must comply with all local laws with respect to your online conduct, as well as with respect to the export of data to or from the United States or to or from your country or residence.

Indemnification.You agree to indemnify and hold CURACORE VET, PLLC, its subsidiaries, affiliates, licensors, content providers, service providers (including, without limitation, Shopify and Litmos), owners, employees, agents, officers, directors, and contractors (collectively, the “Indemnified Parties“) harmless from and against any violation of these Terms of Use, or the policies, guidelines, and rules incorporated by reference, by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any content or information or Service accessed from or through the Website.
  8. Disclaimer.YOUR USE OF THE WEBSITE AND/OR ANY SERVICE IS AT YOUR OWN RISK. If there is any dispute about or involving the Website, Services, these Terms of Use, or any Company policy, guidelines, or rules incorporated into these Terms of Use, you agree that any dispute shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions. You agree to personal and exclusive jurisdiction by, and venue in, the state and federal courts located in Larimer County, Colorado.
